At Cymax Stores, we understand and share your concerns about privacy. This privacy policy describes how Cymax Stores and its affiliates (“we” or “us”) collect, use and share information. It also describes the choices you have regarding our collection, use and retention of your information. We do not sell the personal information of our users.

TYPES OF INFORMATION COLLECTED

Personal information is information that allows an individual to be identified specifically. Non-personal information is information that does not allow an individual to be identified specifically. These features may collect and display your personal information and non-personal information, and may implement cookies, plug-ins and/or APIs in order to function properly. By choosing to connect and share content or communications with any third-party social media platform, you authorize us to share your information with such platform, which information becomes subject to the privacy policy of such platform. We cannot be responsible for any use of your information or content by a third-party platform, which you use at your own risk, and we encourage you to review the privacy policies of any such platforms for further information.

MOBILE DEVICES

If you access our websites through your mobile device, we may collect information regarding your location for the sole purpose of facilitating the fulfillment of your order. We do not share your location information with third parties. You may block access to your location through your mobile devices’ preferences menus. We may also collect information on the type of mobile device used, its mobile device identifier, its mobile operating system, web pages you visit on our mobile website, search terms, the type of mobile internet browsers you use and information about the way you use our mobile website. We use this information to obtain data about your visits to our websites, your general shopping habits, how you use our mobile platforms and how we might improve them.

THIRD PARTY WEBSITES

Our websites include links to other websites whose privacy practices may differ from ours. If you visit any third-party websites or submit information to any such sites, your information is governed by the privacy policy of such websites, and we are not responsible for the information collection and use practices of third-party websites. “DO NOT TRACK” TECHNOLOGY

“Do Not Track” technology allows users to choose in their web browsers whether they want their browsing to be tracked across websites. Industry efforts to standardize “Do Not Track” technology and policies are as yet, ongoing. As these technologies and policies are not yet standardized, we do not currently honor “Do Not Track” requests.

HOW THE INFORMATION WE COLLECT IS USED

In addition to the purposes explained above, the information we collect may be used to:

Other than as described herein, we do not share your personal information with any outside organizations not part of the Cymax Stores family of companies.

If Cymax Stores is involved in a merger, acquisition, reorganization or sale of all or a portion of its assets, customer information will likely be shared for evaluation purposes and included among the transferred assets. We may share any data within our databases and may transfer title to that data as part of any such transaction. Any successor in interest will remain bound by the terms of this Privacy Policy as it relates to your information.

Some of our websites provide the opportunity to post comments or reviews in a public forum. If you choose to submit information on these pages, that information may be publicly available.

We may provide any and all information we have about you to law enforcement or other government agencies pursuant to a subpoena, bankruptcy proceedings, warrant, or other order by a court of competent jurisdiction, or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

YOUR CHOICES REGARDING THE INFORMATION WE COLLECT

MODIFYING OR DELETING YOUR PERSONAL INFORMATION

When you register with Cymax Stores or place an order with us, and enter your email address, you are automatically assigned an account with us. You can log into your account at any time in order to change any of your contact information.

If you would like to delete your personal information, please contact us here, checking the “delete information” box, or by using the contact information provided below. Information you provide in your request will be used solely for verification of your identity. Upon verification of your identity, your personal information will be deleted from our databases. However, in accordance with applicable law, certain of your information may be retained in our archives, for internal lawful purposes, to complete outstanding orders, to resolve disputes, to enforce our rights and/or to comply with legal obligations.

PROMOTIONAL EMAILS

You can unsubscribe to our promotional emails at any time by clicking on the Unsubscribe link in the email you received. Since our databases batch update, you may continue to receive communication for up to 7 days from the date you unsubscribed. We regret, we are no longer able to accept unsubscribe requests by phone or over email to customer service. For updating your email address, please subscribe with your new id and unsubscribe the old one. Unsubscribing from promotional emails does not remove you from receiving important updates related to your account or transactions such as those related to order status or shipment.

CALIFORNIA PRIVACY RIGHTS

This Privacy Policy describes how we may share your personal information for marketing purposes. California residents are entitled to request details regarding the information we have collected on them (if any), including the categories of such information and its sources, the business or commercial purposes for collecting their information, and the categories of third parties with whom we have shared their information (if any). Such requests may be made no more than twice in any twelve month period. RIGHT TO REMOVAL OF POSTED INFORMATION – CALIFORNIA MINORS

If you are under 18 years of age, reside in California, and have a registered account with Cymax Stores, you have the right to request removal of unwanted information that you publicly post on our websites. To request removal of such information, you can contact us as provided below. Upon receiving such a request, Cymax Stores will make sure that the information is not publicly available on our websites, but the information may not be completely or comprehensively removed from our systems or databases.

NON-U.S. BASED CUSTOMERS

Customers residing outside the United States are advised that their personal information may be processed in the United States, and that privacy laws in their home country may be more restrictive than those in the United States. By submitting your personal information to us, you agree to the transfer, storage and processing of such information in the United States.

SECURITY

We appreciate that a customer might be hesitant to send personal information over the internet. Cymax Stores has security measures in place to protect the loss, misuse and alteration of any information you submit on any of our websites. To keep your information safe and secure during transmission, we use high-end encryption technology. However, no method of internet data transmission or electronic storage of information is fully secure, and we cannot guarantee the security of your personal information.

CHANGES TO PRIVACY POLICY

Changes to our Privacy Policy will be indicated on our website, and the “last updated” date at the bottom of this Privacy Policy will be updated accordingly. We will also notify you of updates to the Privacy Policy by sending a notice via the email address listed in your Cymax Stores account, or otherwise on file with Cymax Stores, if any. The updated Privacy Policy will be effective as of its posting on our websites, and your continued use of our websites and services acknowledges your agreement to the terms of such updated Privacy Policy.
